I-881, Application for Suspension of Deportation or Special Rule Cancellation of Removal (Pursuant to Section 203 of Public Law 105-100 (NACARA))
Use this form if you are a noncitizen who is eligible to apply for suspension of deportation or special rule cancellation of removal under the Nicaraguan Adjustment and Central American Relief Act (NACARA).
You may use this form only if you:
- Are a national of Guatemala and:
- First entered the United States on or before Oct.1, 1990, and registered for ABC benefits by submitting an ABC registration form to the former INS on or before Dec. 31, 1991, or affirmatively filed Form I-589 between Dec. 19, 1990, and Dec. 31, 1991, and have not been apprehended at time of entry after Dec. 19, 1990; or
- Filed an application for asylum on or before April 1, 1990.
- Are a national of El Salvador and:
- First entered the United States on or before Sept. 19, 1990, and registered for ABC benefits by either submitting an ABC registration form to the former INS or applying for Temporary Protected Status (TPS) on or before Oct. 31, 1991, or affirmatively filed Form I-589 between Dec. 19, 1990, and Oct. 31, 1991, and have not been apprehended at time of entry after Dec. 19, 1990; or
- Filed an application for asylum on or before April 1, 1990.
- Entered the U.S. on or before Dec. 31, 1990, filed for asylum on, or before Dec. 31, 1991, and at the time that you filed your application for asylum you were a national of:
- Albania;
- Bulgaria;
- Czechoslovakia;
- East Germany;
- Estonia;
- Hungary;
- Latvia;
- Lithuania;
- Poland;
- Soviet Union or any republic of the former Soviet Union;
- Romania;
- Russia; or
- Yugoslavia or any state of the former Yugoslavia.
OR
- Are a spouse, child, or unmarried son or daughter of a person described above, so long as the familial relationship existed at the time when your spouse or parent was granted NACARA 203.
